Sec. 1. AUTHORITY AND PURPOSES. This regulation [ 760 IAC 1-19] is issued pursuant to the authority set out at I.C. 1971, 27-1-3-7.

Many Indiana citizens have purchased coverage under group disability policies which contain pre-existing conditions limitations. If the policy holder replaces an existing group disability policy issued by a succeeding carrier, pre-existing conditions limitations in the new policy may cause unfair hardship on the insureds. The purpose of this regulation [ 760 IAC 1-19] is to eliminate this hardship.
