Sec. 5. The applicant shall meet the following standards, qualifications, or criteria to be issued a permanent sports wagering license:

1. (1) The applicant must qualify to receive a license under IC 4-38.
2. (2) An applicant for a certificate of authority or vendor's license must have all key persons and substantial owners qualify to receive Level 1 occupational licenses under IC 4-33-8 and 68 IAC 2-3.
3. (3) The applicant, in the case of an individual, or the applicant's substantial owners, must be twenty-one (21) years of age.

4. (4) The applicant must demonstrate a level of:

   1. (A) skill;
   2. (B) experience;
   3. (C) knowledge; and
   4. (D) ability;
5. necessary to conduct the sports wagering activities that the applicant seeks to provide.
6. (5) The applicant must not have been convicted of any offense for a violation of a gaming law in any jurisdiction.
7. (6) The applicant must not appear on the exclusion list of any jurisdiction for having violated a rule of gaming.
8. (7) The applicant or the applicant's substantial owners must be in substantial compliance with all state and federal tax laws.
