Sec. 2. Public and accredited nonpublic schools in Indiana shall have the opportunity to apply for a waiver to implement or continue nonstandard courses and curriculum programs. For a school to be granted a waiver, it shall do the following:

1. (1) Provide the department evidence that the proposed course or curriculum program will better serve its students than any authorized by the rules of the board.
2. (2) Assure the department that it will conduct a continuing evaluation of the effectiveness of the proposed courses or curriculum programs and provide the department with annual reports of the results of that evaluation as well as a final report at the termination of the waiver period.
3. (3) Specify the period of time for which the waiver is sought, never to exceed three (3) years, or until the school's next accreditation year under 511 IAC 6.1-1.
