Sec. 3. (a) The BDS shall determine whether an applicant meets the requirements under this article.
(b) Upon review of an initial application, the BDS shall either:
(c) If an applicant is seeking to obtain approval as a Level 2 clinician pursuant to 460 IAC 6-5-4(c)(1)(E), the BDS behavior management committee shall review the applicant's credentials.
(d) The BDS shall notify an applicant in writing of the BDS's determination within sixty (60) days of submission of a completed application.
(e) If an applicant is adversely affected or aggrieved by the BDS's determination, the applicant may request administrative review of the determination. Such request shall be made in writing and filed with the director of the division within fifteen (15) days after the applicant receives written notice of the BDS's determination. Administrative review shall be conducted pursuant to IC 4-21.5.
