Sec. 35. To be approved to provide independence assistance services, an applicant shall be either:

1. (1) approved to provide residential habilitation and support services under this article; or
2. (2) a home health agency; and

certify that, if approved, the entity will provide independence assistance services using only persons who meet the direct care staff qualifications set out in 460 IAC 6-14-5.
