Sec. 2. (a) A provider designated in the individual's ISP as responsible for providing environmental and living arrangement support shall provide services in a safe environment that is:

1. (1) maintained in good repair, inside and out; and

2. (2) free from:

   1. (A) combustible debris;
   2. (B) accumulated waste material;
   3. (C) offensive odors; and
   4. (D) rodent or insect infestation.

(b) The provider shall ensure that:

1. (1) an assessment of the individual's environment is conducted every ninety (90) days; and
2. (2) the results of the assessment are documented.

(c) If an environmental assessment determines that an environment is unsafe for an individual, the provider shall take the appropriate steps to ensure that the individual is safe, including the following, when appropriate:

1. (1) Filing an incident report.
2. (2) Working with the individual and the support team to resolve physical environmental issues.
