Sec. 54. (a) Local health departments may require written operating permits in accordance with IC 16-19-3-27(b)(2), as follows:

1. (1) A written operating permit issued by a local health department shall be signed by the health officer.

2. (2) An operating permit shall be renewed as follows:

   1. (A) At least once every three (3) years for on-site sewage systems having components, other than a septic tank, requiring scheduled inspection and maintenance.
   2. (B) At least once every five (5) years for all other on-site sewage systems.

(b) An operating permit shall identify all components of an on-site sewage system requiring inspection and maintenance.

(c) The records for an operating permit requiring scheduled inspection and maintenance shall contain the following:

1. (1) The name, address, and telephone number of the service company contracted to perform inspection and maintenance.
2. (2) A description of the operation and maintenance document or documents used for scheduled inspection and maintenance.

(d) The owner shall provide the local health department with the following:

1. (1) Written documentation of all scheduled and unscheduled inspection and maintenance within one (1) month of the date performed.
2. (2) A copy of the inspection and maintenance contract.

(e) The operating permit for a residential on-site sewage system in violation of subsection (d) may be revoked by the health officer in accordance with section 55(e) of this rule.
