Sec. 4. (a) A qualified hospital may appeal the office's revocation of its presumptive eligibility status under the provisions of 405 IAC 1-1.4.

(b) The following actions are not sanctions and are not appealable:

1. (1) The office's decision to issue a warning to a qualified hospital and to require a corrective action plan.
2. (2) The office's decision not to exercise its discretion to lift a hospital's request for reinstatement under section 3(e) of this rule.
