Sec. 2. The office shall seek reimbursement for Medicaid benefits paid on behalf of a member by either or both of the following methods:

1. (1) Filing and enforcing a lien in accordance with this rule.
2. (2) Filing and enforcing a claim against the estate of a deceased member in accordance with 405 IAC 2-8.
