Sec. 8. (a) The owner or operator shall install all power lines after the effective date of this article by:

1. (1) burial at least thirty-six (36) inches below the ground surface; or
2. (2) elevation on power poles at least fourteen (14) feet above the ground surface.

(b) The owner or operator shall elevate above ground power lines installed before the effective date of this article as specified in subsection (a) if the division of reclamation determines, after consultation with the landowner, that the power lines pose a hazard to public safety.
