Ind. Admin. Code tit. 312, r. 29-25-18 – Registration and approval of new production fluid storage pits

Sec. 18. (a) An owner or operator shall submit a plan for the construction and operation of a new production fluid storage pit for approval by the division of reclamation. A new pit shall not be constructed until a determination is made that the plan meets the requirements of this section and the division of reclamation has issued a registration number to the pit.

(b) The division of reclamation shall prescribe the form and other information to accompany the production fluid storage pit plan that shall include the following:

(1) Name and address of the owner of the pit.
(2) Name of lease or production unit for the pit.
(3) The location of the pit by quarter, quarter section, township, range, and county.
(4) A map showing the pit and that indicates the distance and direction from the pit to the nearest public road intersection or other prominent landmark.
(5) A plan view or sketch depicting the length, width, height, and maximum design capacity of the structure.
(6) A description of the synthetic liner that will be installed meeting the requirements of section 19(c) of this rule.
(7) A plan view of the subsurface drainage and monitoring system to be installed beneath the pit to meet the requirements of section 19(d) of this rule.
(8) A demonstration that the pit meets the location requirements of section 19(b) of this rule.
(9) Where any portion of the proposed pit will involve excavation, fill, or the construction or erection of structures within the one hundred (100) year floodplain of any river or stream, the plan shall include the following:
1. (A) A demonstration that the top of the pit will be at least two (2) feet above the one hundred (100) year flood elevation.
2. (B) One (1) of the following:
  1. (i) Written confirmation from the division of water that a permit is not required under IC 14-28-1.
  2. (ii) An approved application for construction within a floodway under IC 14-28-1.
