Sec. 48. "Excess spoil" means spoil material disposed of in a location other than the mined-out area; provided that spoil material used to achieve the approximate original contour or to blend the mined-out area with the surrounding terrain in accordance with 312 IAC 25-6-34, 312 IAC 25-6-50, 312 IAC 25-6-98, and 312 IAC 25-6-112 in nonsteep slope areas shall not be considered excess spoil.
