Sec. 41. (a) Written policy, procedure, and practice provide that the facility is a drug-free workplace. This policy is reviewed annually and includes the following:

1. (1) Prohibition of the use of illegal drugs.
2. (2) Prohibition of possession of any illegal drug, except in the performance of official duties.
3. (3) Procedures to be used to ensure compliance.
4. (4) Opportunities available for treatment or counseling, or both, for drug abuse.
5. (5) Penalties for violation of the policy.

(b) This is a mandatory standard.
