Sec. 39. (a) Written policy, procedure, and practice provide that background checks are conducted on all new employees in accordance with state and federal statutes, including the following:

1. (1) Indiana data and communications system.
2. (2) Indiana bureau of motor vehicles, if duties include transportation of youth.
3. (3) Indiana child protective services.
4. (4) Indiana sex and violent offender registry.

(b) This is a mandatory standard.
