Sec. 4. (a) The EM&V plan must include the following for energy efficiency programs and demand response programs in the utility's energy efficiency plan:

1. (1) The type and timing of the measurement activity.
2. (2) The process used to modify the impact estimate for future planning and design of the program.

3. (3) The utility's evaluation procedure. The utility must include information on how it shall collect data to determine:

   1. (A) load impact;
   2. (B) participation level;
   3. (C) utility cost and benefits;
   4. (D) participant cost and benefits;
   5. (E) net energy savings;
   6. (F) net demand reductions;
   7. (G) useful life; and
   8. (H) persistence.

4. (4) How the utility will measure the utility's effectiveness in:

   1. (A) optimizing market penetration of the program;
   2. (B) minimizing free-riders; and
   3. (C) measuring spillover.

5. (5) A comparison of usage and demand patterns of similar participant and nonparticipant groups, through the use of:

   1. (A) customer bill analysis;
   2. (B) engineering estimates;
   3. (C) end-use meter data; or
   4. (D) other methods.

6. (6) The comparison must identify the:

   1. (A) gross energy saving;
   2. (B) gross demand reductions;
   3. (C) net energy savings; and
   4. (D) net demand reductions;
7. attributable to the participation in the energy efficiency program or demand response program.
8. (7) A method to measure rebound effect for an energy efficiency program and demand response program.

(b) In addition to the EM&V plan submitted to the commission under this section, a utility shall submit to the commission and post to the utility's website, annually, a document containing information, data, and results from the utility's EM&V activities, including its load impact evaluation studies.
