As used in this chapter, "department" means the following:

1. (1) For a consolidated city, the department of public works.
2. (2) For all other municipalities, the department of storm water management established under section 4 of this chapter.
3. (3) For a county, the department of storm water management established under section 4.5 of this chapter.
