As used in this chapter, "qualified agency" refers to a nonprofit agency for individuals with disabilities (as defined by IC 16-32-2-1 (a)) that meets all of the following conditions:
- (1) The agency is a nonprofit organization that is incorporated in Indiana.
- (2) The agency complies with Indiana laws governing private nonprofit organizations.
- (3) The agency complies with all the requirements of the United States Department of Labor.
- (4) The agency meets the standards adopted by the secretary of family and social services.
- (5) The agency makes reports under IC 16-32-2-7 .
