Ind. Code § 5-1.2-2-32

"Health facility"

As added by P.L.189-2018, SEC.25. Amended by P.L.145-2026, SEC.13.

"Health facility", for purposes of IC 5-1.2-7 , means any facility or building that is:

  1. (1) owned or used by a participating provider;
  2. (2) located:

    1. (A) in Indiana; or
    2. (B) outside Indiana, if the participating provider that operates the facility or building, or an affiliate of the participating provider, also operates a substantial health facility or facilities, as determined by the authority, in Indiana; and
  3. (3) utilized, directly or indirectly:

    1. (A) in:

      1. (i) health care;
      2. (ii) habilitation, rehabilitation, or therapeutic services;
      3. (iii) medical research;
      4. (iv) the training or teaching of health care personnel; or
      5. (v) any related supporting services;
    2. (B) to provide:

      1. (i) a residential facility for individuals with a physical, mental, or emotional disability;
      2. (ii) a residential facility for individuals with a physical or mental illness; or
      3. (iii) a residential facility for the elderly; or
    3. (C) as a licensed child caring institution that provides residential care described in IC 12-7-2.1-60 (1) or corresponding provisions of the laws of the state in which the facility or building is located.
