The division shall carry out the commission's duties under IC 4-32.2-8 and IC 4-32.2-9 with respect to any person that is:

1. (1) licensed under IC 4-32.2 ; and
2. (2) suspected of violating IC 35-45-5-3 , IC 35-45-5-3.5 , or IC 35-45-5-4 .
