A person who:

1. (1) discovers or handles human remains when it appears the deceased person died:

   1. (A) by violence, suicide, or accident;
   2. (B) suddenly, while in apparent good health;
   3. (C) while unattended;
   4. (D) from poisoning or an overdose of drugs;
   5. (E) as the result of a disease that may constitute a threat to public health;

   6. (F) as the result of:

      1. (i) a disease;
      2. (ii) an injury;
      3. (iii) a toxic effect; or

      4. (iv) unusual exertion;

         incurred within the scope of the deceased person's employment;

   7. (G) due to sudden infant death syndrome;
   8. (H) as the result of a diagnostic or therapeutic procedure; or
   9. (I) under any other suspicious or unusual circumstances; and

2. (2) knowingly or intentionally fails to report the discovery or handling of the human remains to a:

   1. (A) public safety officer;
   2. (B) coroner;
   3. (C) funeral director;
   4. (D) physician; or

   5. (E) 911 telephone call center;

      within three (3) hours after finding the human remains;

      commits failure to report the discovery or handling of human remains, a Class A misdemeanor.
