1. (a) A person who, with the intent to defraud:

   1. (1) advertises for sale;
   2. (2) sells;
   3. (3) uses; or

   4. (4) installs;

      any device that causes an odometer to register mileage other than the mileage driven by the vehicle as registered by the odometer within the manufacturer's designed tolerance commits a Level 6 felony.

2. (b) A person who, with the intent to defraud:

   1. (1) disconnects, resets, or alters the odometer of any motor vehicle with intent to change the number of miles or kilometers indicated on the odometer; or

   2. (2) sells a motor vehicle that has a broken odometer or an odometer that is not displaying correct mileage of the vehicle;

      commits a Level 6 felony.
