Ind. Code § 35-43-5-23

Notary fraud; notarial fraud

  1. (a) The following terms are defined for this section:

    1. (1) "Acknowledgment" has the meaning set forth in IC 33-42-0.5-2 .
    2. (2) "Notarial officer" has the meaning set forth in IC 33-42-0.5-19 .
  2. (b) A notarial officer who, with intent to defraud, knowingly or intentionally:

    1. (1) affixes a person's signature to a blank affidavit or certificate of acknowledgment; and
    2. (2) delivers that affidavit or certificate to another person;

      with the intent that it be used as an affidavit or acknowledgment commits notary fraud, a Level 6 felony.

  3. (c) A person who knowingly or intentionally uses an affidavit or certificate described in subsection (b) for any purpose commits notarial fraud, a Level 6 felony.
