If an end user has not been paid the amount due within ninety (90) days after the date the notice is received by the customer as provided in section 7 of this chapter, the end user may sell the special tool at a public auction if:

1. (1) the special tool is still in the end user's possession; and
2. (2) the end user complies with section 9 of this chapter.
