A determination by the commission or a county election board that a person who has filed a certification under section 2 of this chapter has accepted funds:

1. (1) from a prohibited source;
2. (2) in excess of the amount set forth in section 2 of this chapter; and

3. (3) during the period described in section 2 of this chapter;

   creates a presumption that the person has violated section 2 of this chapter.
