1. (a) A county election board shall remove a precinct election officer and declare the office vacant if:

   1. (1) at any time before or during an election the county election board is notified by the affidavit of two (2) or more voters of the precinct that the officer is not qualified; and
   2. (2) the board determines that the statements made in the affidavit concerning the disqualification of the precinct election officer are true.

2. (b) If the disqualified officer has taken the oath of office required by this chapter, the circuit court clerk shall attach the oath to the poll list and shall place the affidavit and oath before the next grand jury of the county.
