Ind. Code § 3-12-11-5

Failure to file cross-petition or answer to a petition; admission of truth; presumption

The failure to file either a cross-petition or an answer to a petition for a recount or contest does not:

  1. (1) constitute an admission of the truth of the allegations of the petition; or
  2. (2) imply a presumption in favor of the petition.
