1. (a) A caller who violates this chapter commits a deceptive act that is actionable by the attorney general under IC 24-5-0.5-4 and that is subject to:

   1. (1) the remedies and penalties under IC 24-5-0.5-4 (c), IC 24-5-0.5-4 (d), and IC 24-5-0.5-4 (f); and

   2. (2) a civil penalty of not more than the following:

      1. (A) Ten thousand dollars ($10,000) for the first violation.
      2. (B) Twenty-five thousand dollars ($25,000) for each violation after the first violation.
2. (b) A civil penalty recovered by the attorney general under subsection (a)(2) for a violation of this chapter shall be deposited in the consumer protection division telephone solicitation fund established by IC 24-4.7-3-6 to be used for the administration and enforcement of this chapter.
