"Eligible student", for purposes of section 8 of this chapter, means a person who:

1. (1) is a member of the Indiana National Guard:

   1. (A) in active drilling status; and
   2. (B) who has not been absent without leave within the twelve
   3. (12) months immediately preceding the date the person applies for a tuition scholarship under this chapter;
2. (2) does not possess a bachelor's degree from an approved postsecondary educational institution;
3. (3) possesses the requisite academic qualifications;
4. (4) meets the requirements of the state educational institution in which the person is enrolled or will enroll; and

5. (5) meets all other eligibility requirements as determined by the commission.
