1. (a) For purposes of section 7 of this chapter, an emergency when used with respect to repair or replacement is:

   1. (1) a fire;
   2. (2) a flood;
   3. (3) a windstorm;
   4. (4) a mechanical failure of any part of a structure; or
   5. (5) an unforeseeable circumstance.
2. (b) For purposes of section 7 of this chapter, an emergency when used with respect to site acquisition is the unforeseeable availability of real property for purchase.
