Ind. Code § 20-32-3-2

"Student"

As used in this chapter, "student" refers to a student who meets the following conditions:

  1. (1) Is enrolled in a public school, a state accredited nonpublic school, or a nonpublic school that has requested and received from the state board specific approval for the school's education program.
  2. (2) Is in at least grade 9.
  3. (3) If the student is a student with a disability (as defined in IC 20-35-1-8 ), would benefit from the participation under this chapter as determined by the individualized education program for the student.
