Ind. Code § 20-26-3-5

Constitutional or statutory exercise of powers; written policy

As added by P.L.1-2005, SEC.10.
  1. (a) If there is a constitutional or statutory provision requiring a specific manner for exercising a power, a school corporation that exercises the power shall exercise the power in the specified manner as a minimum requirement.
  2. (b) If there is not a constitutional or statutory provision requiring a specific manner for exercising a power, a school corporation that exercises the power shall:

    1. (1) adopt a written policy prescribing a specific manner for exercising the power; or
    2. (2) comply with a statutory provision permitting a specific manner for exercising the power.
  3. (c) A written policy under subsection (b)(1) must be adopted by the governing body of the school corporation.
