1. (b) If a payment is from a fund of the board that is not subject to budgeting and appropriation but has been transferred to the board for specific purposes, the payment must be made:

   1. (1) in accordance with the terms of the fund being drawn upon that are made available to the board; and
   2. (2) after the superintendent has approved the proposed payment.

2. (c) If a payment is from a fund of the board that is not subject to budgeting and appropriation and is unrestricted as to the purposes for which it may be expended, the payment must be made in accordance with the prior:

   1. (1) direction of the superintendent; or
   2. (2) order of the board.
3. (d) Not later than thirty (30) days after a payment under subsection

4. (b) or (c) is made from a fund of the board, the superintendent shall report the payment to the board for approval.

Sec. 11. (a) Except as provided in subsections (b) and (c), a payment made from money of the board must be made in accordance with budget appropriations.
