1. (a) If the design and specifications for a residential onsite sewage system proposed for construction or installation at a particular location have been approved by either:

   1. (1) the local health department; or

   2. (2) at the option and expense of the property owner:

      1. (A) a professional engineer registered under IC 25-31-1 ;
      2. (B) a registered soil scientist (as defined in IC 25-31.5-1-7 );
      3. (C) an individual or entity engaged in the business of constructing and installing residential onsite sewage systems; and

      4. (D) the designer of the system, if the system was designed by someone other than a person referred to in clause (A) or (C);

         the local health department shall issue a permit for the residential onsite sewage system not later than thirty (30) business days after receiving a complete application for the permit.

2. (b) Subject to IC 16-19-3-27.5 , IC 16-19-3-27.6 , and sections 5 and 6 of this chapter, this section does not affect the authority of a local health department to inspect an onsite sewage system before or after the system's installation.
