1. (a) The state department shall adopt rules under IC 4-22-2 to:

   1. (1) define a birth problem; and

   2. (2) establish reporting requirements regarding birth problems for:

      1. (A) hospitals;
      2. (B) physicians;
      3. (C) local health departments;
      4. (D) home deliveries, as described in section 1(8) of this chapter; and
      5. (E) other health care providers designated by the state department.

2. (b) In adopting rules regarding the reporting of birth problems, the state department shall give consideration to the following factors:

   1. (1) The extent to which a condition can be measured or identified.
   2. (2) The extent to which there is a known intervention for a condition.
   3. (3) The significance of the burden imposed on the life of the individual by a condition.
   4. (4) Other factors that the state department determines appropriate.
