As used in this chapter, "restricted use pesticide" means:

1. (1) any pesticide classified as restricted by the administrator of the United States Environmental Protection Agency; or

2. (2) a pesticide that the board has determined to be unduly hazardous to persons, animals, plants, wildlife, waters, or lands other than the pests the pesticide is intended to prevent, destroy, control, or mitigate.
