As used in this chapter, "licensed pesticide business" means any licensed person that owns, operates, or manages a business that is engaged in or professes to be engaged in:

1. (1) using any pesticide product, including restricted use pesticides; or

2. (2) making diagnostic inspections or reports to determine infestations of wood destroying pests.
