As used in this chapter, "fungi" means all nonchlorophyll-bearing thallophytes (all nonchlorophyll-bearing plants of a lower order than mosses and liverworts), including:

1. (1) rusts;
2. (2) smuts;
3. (3) mildews;
4. (4) molds;
5. (5) yeasts;
6. (6) bacteria; and

7. (7) viruses;

   except those on or in a living human or other animal.
