The division may collect fees for special services provided to a person who is not described in section 1 of this chapter. Fees collected under this section:

1. (1) must be prescribed by rule;
2. (2) may not exceed the expense incurred by the department to provide those services; and

3. (3) shall be deposited in the entomology and plant pathology fund.
