A person who knowingly or intentionally violates section 1, 2, or 3 of this chapter commits a Class C misdemeanor. However, the offense is:

1. (1) a Class A misdemeanor if the accident or collision results in an injury to a person;

2. (2) a Level 6 felony if:

   1. (A) the accident or collision results in serious bodily injury to a person; or
   2. (B) within the five (5) years preceding the commission of the offense, the person had a previous conviction of any of the offenses listed in IC 9-30-10-4 (a), IC 35-46-9-6 (before its repeal), or IC 14-15-8-8 (before its repeal); or

3. (3) a Level 5 felony if the accident or collision results in the death of a person.
