Ind. Code § 14-13-1-9
(a) In addition to the voting members of the commission, the governor shall appoint four (4) legislative members from the general assembly from recommendations made by the speaker of the house of representatives and the president pro tempore of the senate as follows:

(c) The legislative members appointed under subsection (a)(1) and (a)(2) must meet the following criteria:
(d) The term of a legislative member is two (2) years. Subject to the following, the term expires June 30 of an odd-numbered year:
(e) If a vacancy occurs among the legislative members, the governor shall fill the vacancy as recommended by the speaker of the house of representatives or the president pro tempore of the senate, as appropriate. The governor shall ensure that the legislator appointed to fill the vacancy meets the criteria set forth in subsections (a) and (c).
