1. (a) If an applicant who submitted an approved voluntary remediation work plan proceeds with the work plan, the department or a person under contract with the department shall do the following:

   1. (1) Oversee and review the implementation of the voluntary remediation work plan.
   2. (2) Make regular reports to the commissioner concerning the remediation.
2. (b) Upon submission of a report to the commissioner, the commissioner may evaluate the remedial action to verify the action is achieving project goals. If project goals are not met, the commissioner may require modification of the voluntary remediation work plan.

3. (c) If the parties are unable to agree to a modification as provided for in subsection (b) within one hundred eighty (180) days, the commissioner or applicant may withdraw the project from the voluntary remediation work program. Projects withdrawn from the voluntary remediation work program may be referred to the state clean-up program.
