A permit is not required to use foundry sand that meets Type III criteria under 329 IAC 10-9 for the following activities:

1. (1) As a daily cover for litter and vermin control at a landfill in accordance with any applicable permits issued for the landfill.
2. (2) As a protective cover for a landfill leachate system in accordance with any applicable permits issued for the landfill.
3. (3) For use as capped embankments for ground and sight barriers under ten thousand (10,000) cubic yards or embankments for airports, bridges, or overpasses.

4. (4) For use:

   1. (A) in a land application operation; or

   2. (B) as a soil amendment;

      if the application or amendment does not include the operation of a landfill.

5. (5) As a structural fill base capped by clay, asphalt, or concrete for the following:

   1. (A) Roads.
   2. (B) Road shoulders.
   3. (C) Parking lots.
   4. (D) Floor slabs.
   5. (E) Utility trenches.
   6. (F) Bridge abutments.
   7. (G) Tanks and vaults.
   8. (H) Construction or architectural fill.
   9. (I) Other similar uses.

6. (6) As a raw material constituent incorporated into another product, including the following:

   1. (A) Flowable fill.
   2. (B) Concrete.
   3. (C) Asphalt.
   4. (D) Brick.
   5. (E) Block.
   6. (F) Portland cement.
   7. (G) Glass.
   8. (H) Roofing materials.
   9. (I) Rock wool.
   10. (J) Plastics.
   11. (K) Fiberglass.
   12. (L) Mineral wool.
   13. (M) Lightweight aggregate.
   14. (N) Paint.
   15. (O) Plaster.
   16. (P) Other similar products.
