(a) The division may adopt emergency rules under IC 4-22-2-37.1 to implement section 5 of this chapter. An emergency rule adopted under this section expires on the earlier of:
(1) one (1) year after the date on which the rule was accepted for filing under IC 4-22-2-37.1 (e); or
