This chapter does not preclude the authority of the Indiana department of health to regulate:

1. (1) a home health agency, as provided in IC 16-27 and rules adopted under IC 16-27 ; or
2. (2) a health facility, as provided in IC 16-28 and rules adopted under IC 16-28 .
