Rule 375-3-1-.12. Re-Examination Upon Failure

1. (1) Any applicant for a driver's license of any class, with the exception of CDL, who fails any part of the driving examination may re-attempt the examination according to the following schedule:

   1. (a) First Failure--after the first failure the applicant must wait until the next day before retaking those parts of the driving examination that were failed earlier
   2. (b) Second or Subsequent Failure--after the second failure the applicant must wait seven (7) calendar days before retaking those parts of the driving examination that were failed earlier.
   3. (c) Reserved.
2. (2) Any failure of any part of the examination may equal failure of the complete examination for that testing day.
