Rule 300-2-4-.13. Substitute State Average Unemployment Rate
If the statewide average unemployment rate for April or October is not published or not available in time for use under Code Section 34-8-193(d), the Department shall substitute the statewide average unemployment rate for the most recent month available. The substitute rate shall remain in effect for the period the unavailable rate would have applied, provided, however, that if the unavailable rate later becomes available, the Department may, in the discretion of the Commissioner, make retroactive or prospective adjustments to ensure all individual calculations under Code Section 34-8-193(d) for initial claims filed during the period are based on the applicable April or October rate, but only if such adjustments are administratively feasible and consistent with due process.
