Rule 120-2-67-.04. Portability Eligibility

The requirements for an insured to be eligible for portability under a group health insurance benefit plan as required in O.C.G.A. § 33-30-15 are as follows:

1. (a) The newly eligible insured was enrolled under similar coverage within the previous 90 days and is a "newly eligible employee" as defined in O.C.G.A. § 33-30-15(a)(4)(A) and (B), or a late enrollee subject to all provisions of this Regulation Chapter which apply to late enrollees and subject to the terms of coverage; or
2. (b) The insured was subject to an exclusion or waiver for a preexisting condition under the group health insurance policy or contract prior to the effective date of the Rule for that policy or contract.
