Rule 111-8-47-.02. Governing Body

1. (1) There shall be a governing body which assumes full legal responsibility for the overall conduct of the facility.
2. (2) The ownership of the facility shall be fully disclosed to the Department. In the case of corporations, partnerships and other bodies created by statute, the corporate officers and all others owning ten percent or more of the corporate stock or ownership shall be made known to the Department.
3. (3) The governing body shall be responsible for compliance with all applicable laws and regulations pertaining to the facility.
4. (4) The governing body shall certify to the Commissioner, the name of the person to whom is delegated the responsibility for the management of the facility, including the carrying out of rules and policies adopted by the governing body. This person shall be known as the administrator.
5. (5) The word hospital, sanitorium or sanitarium shall not be used in the official title of any home permitted under the provisions of these rules and regulations.
