Fla. Stat. § 922.095
A person who is convicted and sentenced to death must pursue all possible collateral remedies in state and federal court in a timely manner. If any court refuses to grant relief in a collateral postconviction proceeding, the convicted person has 90 days in which to seek further collateral review. Failure to seek further collateral review within the 90-day period constitutes grounds for issuance of a death warrant under s. 922.052 or s. 922.14.
