There is created a Department of Banking and Finance.

1. (1) The head of the Department of Banking and Finance is the Comptroller.

2. (2) As provided in s. 4(d), Art. IV of the State Constitution, the purpose of the Comptroller is to serve as the chief fiscal officer of the state, and he or she shall settle and approve accounts against the state.

   1. (a) Function as a criminal justice agency within the meaning of s. 943.045(10)(e); and

   2. (b) Have a separate budget.

   ¹(3) The Comptroller shall execute the programs and policies as adopted by the Legislature.

   ¹(4) There is created as a subunit within the Department of Banking and Finance the Office of Financial Investigations. The Office of Financial Investigations shall:
